Customer Expectations
Subject to the following paragraph below, if you are a consumer we shall not be liable to you for any loss or damage in circumstances where: Any claim under this condition must be in writing and must contain full details of the claim including the reference numbers of any allegedly defective Goods or Services. If you are a trade customer then our aggregate liability (whether in contract or for negligence or breach of statutory duty or otherwise howsoever) to you for any loss or damage of whatsoever nature and howsoever caused shall be limited to and in no circumstances shall exceed the price of the goods in question. We should be given reasonable opportunity and facilities to investigate any claims made under this condition and the Customer shall if so requested in writing by us to return any Goods or Services which are the subject of any claim. When returning goods please adhere to our advice on correct packaging and Return procedures. Under no circumstances shall we have any liability of whatever kind for any technical information, recommendations, statements or advice furnished by us or our employees, sub-contractors or other agents not given in writing in response to a specific written request from the Customer before the Contract is made, or any variations in the quantities or dimension of any Goods or Services or changes of their specifications or substitution of any materials or components; if the variation or substitution does not materially effect the characteristics of the Goods or services, and the substituted materials or components are of a quality equal or superior to those originally specified. |
